On the shores of the juridical: Peasants and justice in Santiago del Estero

Abstract

The aim of this work will focus on how the dispute over the legal possession of land held by peasant communities is expressed in the juridical field. We give priority over other areas because, in the democratic tradition, it determines what is just and unjust, that is, the measure itself provides that each party only takes what it deserves (Rancière, 1996). In this context, I am particularly interested in two issues. The first, addressing the manner in which the various subjects involved in the events represent a judicial manner. The second issue refers to examine how judges are moved from the imagination of these languages to another, which involves making a decision. It means to analyze and understand the role of judges regarding the resolution of conflicts between peasant and entrepreneurs.
